The Environment Protection Act 2017, which came into effect ion 1 July 2021, provides Victoria’s Environment Protection Authority with more power to prevent harm to public health and the environment from pollution and waste. The general environmental duty (GED) is a centrepiece of the new laws, and applies to all Victorians. If you conduct activities that pose a risk to human health and the environment, you must understand those risks, and take reasonably practicable steps to eliminate or minimise them. There are also new Duties to Notify EPA and to Manage any contamination for any person in management or control of contaminated land. There are also changes to the way wastes are regulated, including new requirements for regulating fill materials. Anyone involved in engineering works in Victoria needs to understand the new requirements.
